1. Introduction
Welcome to Comfortkeep Home LLC (“Company,” “we,” “our,” or “us”). These Terms & Conditions govern your use of our services, including but not limited to in-home senior care, our website, and all communication methods such as SMS, email, and phone. By engaging with our services, you expressly agree to these Terms & Conditions.
2. Scope of Services
Comfortkeep Home LLC provides non-medical in-home care services tailored to the needs of seniors and individuals requiring assistance with daily living activities. These services may include, but are not limited to:
- Personal care assistance (bathing, grooming, hygiene)
- Meal preparation and feeding assistance
- Light housekeeping and laundry
- Medication reminders
- Companionship and mobility support
3. Service Agreements
All clients are required to sign a Service Agreement, which serves as a formal document of understanding between the client and Comfortkeep Home LLC. This agreement governs the caregiver-client relationship, along with the terms and conditions for payment and refund policies. By signing the Service Agreement, the client acknowledges and accepts the stipulations set forth regarding the provision of services, including service fees, scheduling, cancellation, and refund terms.
4. Billing & Payment
Services are billed either on an hourly or daily basis, as explicitly agreed upon in the Service Agreement. Payment must be prepaid before the commencement of services, and unless otherwise agreed upon, the payment structure will be based on a week-to-week agreement, meaning clients will be billed for the upcoming week of services in advance. All payments must be made via the method outlined in the Service Agreement, such as credit card, ACH transfer, or check.
In the event of late payment, the client acknowledges that additional fees may be assessed at the sole discretion of Comfortkeep Home LLC.
5. Appointment Cancellations & Rescheduling
Clients are required to provide at least 24 hours’ notice for cancellations to avoid incurring charges for the missed service. Any emergency cancellations will be evaluated on a case-by-case basis, and such cancellations may incur a fee at the discretion of Comfortkeep Home LLC.
6. SMS Communications
By providing a phone number and agreeing to receive text messages, you expressly consent to receive SMS communications from Comfortkeep Home LLC, which may include, but are not limited to:
- Appointment confirmations and reminders
- Caregiver updates and service changes
- Customer support and policy changes
Messages will typically be sent weekly, but frequency may vary based on service needs. You may receive multiple messages per week depending on your engagement with Comfortkeep Home LLC You may opt out of SMS communications at any time by replying STOP to any SMS message. Upon opting out, you will receive a final confirmation message within 24 hours verifying the cessation of messages. Message and data rates may apply, and clients are encouraged to review their mobile plan to understand associated costs.
Privacy Policy and Data Use:
All data collected through SMS communication will be handled in accordance with Comfortkeep Home LLC’s Privacy Policy, which can be accessed at Privacy Policy This includes a commitment that no opt-in or opt-out information related to SMS services will be shared with third parties for marketing or promotional purposes, except as necessary to fulfill communication needs directly related to the provision of in-home care services. The frequency of messages will vary based on service requirements, and the client is entitled to assistance by replying HELP to any message to receive Comfortkeep Home LLC’s contact details.
7. Limitation of Liability
Comfortkeep Home LLC shall not be liable for:
- Any medical complications arising outside the scope of the non-medical care services we provide.
- Accidents, injuries, or damages occurring within the client’s home unless due to gross negligence or misconduct by our personnel.
- Interruptions or modifications of services due to unforeseen circumstances such as natural disasters, power outages, or other events beyond our control.
8. Data Protection & Privacy
Comfortkeep Home LLC is fully committed to safeguarding the privacy of all personal data. Any personal data collected will be handled in strict accordance with our Privacy Policy, available at Privacy Policy, which outlines our practices regarding the collection, use, storage, and protection of your personal information. We employ stringent technical, organizational, and administrative safeguards, including encryption, role-based access, and regular audits, to protect your data from unauthorized access, alteration, or disclosure.
9. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms & Conditions shall be resolved in the appropriate courts located within the State of California.
10. Changes to Terms
Comfortkeep Home LLC reserves the right to modify these Terms & Conditions at any time. All modifications will be communicated to clients via email or SMS, and clients will have the opportunity to review and accept the revised terms. By continuing to use our services, clients acknowledge their acceptance of any changes to these Terms & Conditions.
